How trademark classification works in India

India uses the international NICE Classification, which divides every possible good and service into 45 classes. Classes 1–34 cover goods (physical products) and Classes 35–45 cover services. When you apply to the Indian Trade Marks Registry, your mark is protected only for the goods or services in the class(es) you file in — so choosing the right class is one of the most important decisions in a trademark application.

Many businesses need more than one class. A clothing brand that also sells online might file in Class 25 (clothing) and Class 35 (retail). A software startup often files in Class 9 (downloadable apps) and Class 42 (SaaS and software development). Each class adds a separate government filing fee, so the goal is to cover what you actually do — and plan to do soon — without over-filing.

Picking a class is only half the battle: a mark can be refused if an identical or similar mark already exists in the same class. Before you file, it's worth running a conflict check against the live Indian Trade Marks Registry.

What are trademark classes in India?

India follows the NICE Classification, which sorts all goods and services into 45 classes — Classes 1 to 34 are goods and Classes 35 to 45 are services. When you file a trademark you must register it in the class(es) that cover what you actually sell or do.

How many trademark classes are there?

There are 45 classes in total: 34 for goods and 11 for services. The Indian Trade Marks Registry applies the same NICE Classification used internationally.

Which trademark class is software in?

Downloadable software and mobile apps are goods in Class 9. Software provided as a service (SaaS) and software development are services in Class 42. Many tech businesses file in both Class 9 and Class 42, and add Class 35 if they also run an online marketplace or retail platform.

Which class is clothing or apparel?

Clothing, footwear, and headwear all fall in Class 25. If you also sell the clothing through a store or online platform, you may also want Class 35 (retail services).

Can one trademark cover multiple classes?

Yes. A single brand can be protected across several classes through a multi-class application, but each class carries its own government fee. Pick the classes that match your current and near-term goods and services.

How do I do an IP India class search?
