How trademark fees work in India

Trademark fees in India are fixed by the Trade Marks Rules, 2017 and charged per class, per mark. There are two tiers: a concessional rate for individuals, startups, and small enterprises (₹4,500 per class online) and a standard rate for companies and other entities (₹9,000 per class online). Filing online (e-filing) is 10% cheaper than filing physically at the Registry.

Because the fee is per class, a multi-class application multiplies the cost — a brand filed in Class 25 (clothing) and Class 35 (retail) pays for two classes. Choosing the right trademark classes up front avoids both over-filing and gaps in protection.

A registered trademark lasts 10 years from the application date and is renewable indefinitely. Renewal (Form TM-R) costs ₹9,000 per class online. Individuals, recognised startups (with DPIIT recognition), and small enterprises/MSMEs qualify for the lower ₹4,500-per-class tier. Companies, LLPs, partnerships, and other entities pay the standard ₹9,000-per-class tier.

Does this include lawyer or agent fees?

No. The calculator shows only the official government fee payable to the Trade Marks Registry. If you engage a trademark attorney or agent, their professional fee is separate and varies.

Is e-filing cheaper than physical filing?
