How Indian IP deadlines work
Trademark renewal
An Indian trademark registration lasts 10 years and must be renewed every 10 years to stay in force (Trade Marks Act 1999, §25). The clock runs from the date of application — §23(1) deems the registration date to be the filing date — not the certificate date. A renewal can still be filed up to 6 months late with a surcharge (§25(3)), and a lapsed mark can be restored within 6–12 months of expiry (§25(4)).
Patent annuities & RFE
Indian patents run for 20 years from filing (Patents Act 1970, §53). Renewal (annuity) fees begin from the 3rd year — the year-N fee falls due on the (N-1)th anniversary of the filing date (Rule 80). Separately, a Request for Examination (RFE) must be filed within 31 months of filing for applications dated 15 March 2024 onward (Patents Amendment Rules 2024), or 48 months for earlier filings (Rule 24B). Missing the RFE deadline deems the application withdrawn.
Design extension
A registered design is protected for 10 years from registration and can be extended once by a further 5 years, for a maximum of 15 years (Designs Act 2000, §11). The extension must be applied for before the initial 10-year term expires — there is no perpetual renewal as with trademarks.

How is a trademark renewal date calculated in India?
A trademark is renewed 10 years from the date of application. Under §23(1) of the Trade Marks Act 1999, the registration date is deemed to be the filing date, so the 10-year renewal cycle runs from when you filed, not from when the certificate issued.
When are patent renewal (annuity) fees due in India?
Annuity fees start from the 3rd year of a patent's 20-year term. The fee for year N is payable before the end of year N-1 — i.e. on the (N-1)th anniversary of the filing date (Rule 80). If a patent is granted late, all annuities that have already accrued are payable within 3 months of the grant date.
What is the RFE (Request for Examination) deadline for an Indian patent?
For applications filed on or after 15 March 2024, the RFE must be filed within 31 months of the filing or priority date under the Patents (Amendment) Rules 2024. For applications filed on or before 14 March 2024, the window is 48 months (Rule 24B). If no RFE is filed in time, the application is treated as withdrawn.
How long does a registered design last in India?
A design is protected for 10 years from the date of registration, extendable once by 5 years on an application made before the first term expires — a maximum of 15 years in total (§11, Designs Act 2000).
