How to register a copyright in India
Copyright is one of the easiest IP rights to register yourself in India. Here's what it protects and the full process — from Form XIV to your registration certificate.
Check your work is copyrightable
Copyright protects original literary, dramatic, musical and artistic works, plus cinematograph films and sound recordings — think books, code, lyrics, music, paintings, logos, photographs, and websites. It does not protect ideas, names, or slogans (those are trademark territory). Copyright exists automatically on creation; registration is optional but gives you strong, dated proof of ownership that holds up in court.
Create an account on the Copyright Office portal
Registration is handled by the Copyright Office (copyright.gov.in), not the IP India trade-marks portal. Create a user account there — this is a different system from trademarks and patents.
File Form XIV and pay the fee
Apply using Form XIV, one application per work. You'll enter the title, the author and owner details, the year of publication, and the category of work, and upload a copy of the work. The government fee is modest — roughly ₹500 per work for most literary/artistic works (higher for software, artistic works used on goods, films, and sound recordings). Pay online and you'll get a diary number straight away.
Wait out the 30-day objection window
After filing there's a mandatory 30-day waiting period in which anyone can object to your claim. If no objection is filed, your application moves to examination. If someone objects, the Registrar holds a hearing before deciding. This window is why copyright registration takes a few months even though the form itself is quick.
Examination and your certificate
An examiner reviews the application and may raise a discrepancy for you to clear. Once satisfied, the work is entered in the Register of Copyrights and you receive your Certificate of Registration — your formal, dated proof of ownership. In India copyright generally lasts the author's lifetime plus 60 years.
This guide is educational and not legal advice. Fees and categories vary by work type and change over time — confirm the current fee on the Copyright Office portal before filing. For disputed ownership or assignments, consider professional advice.
Frequently asked questions
Can I register a copyright in India myself?
Yes. You can file a copyright application directly on the Copyright Office portal (copyright.gov.in) using Form XIV, without an agent. Copyright registration is one of the more self-serviceable IP processes in India — the form is straightforward and the fee is low.
How much does copyright registration cost in India?
The government fee is modest — around ₹500 per work for most literary, dramatic, musical, and artistic works. Software, artistic works used on goods, cinematograph films, and sound recordings carry higher fees. The fee is per work, per application.
Do I need to register copyright in India?
No. Copyright exists automatically the moment an original work is created — registration is optional. However, a registration certificate is strong, dated, official proof of ownership and is very useful as evidence if you ever need to enforce your rights in court.
What is Form XIV?
Form XIV is the application form to register a copyright in India, filed with the Copyright Office. It captures the work's title, the author and owner, the year and country of publication, and the category of work, and is submitted with a copy of the work and the fee.
How long does copyright registration take in India?
Usually a few months. There is a mandatory 30-day window after filing for objections, followed by examination. If no objection or discrepancy arises, the certificate typically issues within a few months of filing.
What's the difference between copyright and a trademark?
Copyright protects original creative works (books, music, art, code, films). A trademark protects brand identifiers — names, logos, and slogans used to distinguish goods or services. A logo can be both: registrable as an artistic work under copyright and as a trademark. See our guide on how to register a trademark in India.
